PLEASE READ CAREFULLY - THIS IS A LEGAL DOCUMENT

By signing this agreement, I acknowledge that I have read, understand, and agree to the following terms and conditions regarding my participation in a guided kayak fishing tour with Hooked On Sharks LLC.

​

1. Assumption of Risk

​

I understand that participating in a kayak fishing tour involves inherent risks, including but not limited to:

​

• Capsizing, drowning, or exposure to open water

• Weather conditions, tides, currents, and marine wildlife

• Physical exertion and injuries from paddling, fishing, or handling gear

• Risks associated with using rented or provided equipment (kayaks, paddles, life jackets, fishing rods, and other gear)
   

I acknowledge that Hooked On Sharks LLC, its owners, employees, agents, and affiliates cannot eliminate these risks and that my participation is voluntary.

2. Equipment Use & Responsibility

​

• Provided Equipment: I understand that Hooked On Sharks LLC provides all necessary equipment, including kayaks, paddles, life jackets, and fishing gear.

• Proper Use Required: I agree to use all equipment as instructed by the guide and to wear a U.S. Coast Guard-approved life jacket at all times while in the kayak.

• Liability for Damage: I accept responsibility for any damage, loss, or misuse of the provided equipment due to negligence, improper handling, or failure to follow instructions. I agree to reimburse Hooked On Sharks LLC for any damage or loss caused by my actions.
   

3. Fishing License Requirement

• I understand that I am responsible for obtaining and possessing a valid Florida Saltwater Fishing License at the time of the tour.

• Failure to provide proof of a valid license may result in denial of participation without a refund.

4. Weight Limit and Safety Considerations

​

• I acknowledge that the provided kayaks have a maximum weight limit.

• Participants over 275 lbs. must inform Hooked On Sharks LLC in advance so appropriate accommodations can be considered.

• Service may be denied for safety reasons if the participant exceeds the kayak’s weight capacity.

5. Release of Liability & Hold Harmless Agreement

​

To the fullest extent permitted by law, I waive, release, and discharge Hooked On Sharks LLC, its owners, employees, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to my participation in the guided kayak fishing tour, including but not limited to:

​

• Personal injury, illness, or death

• Property damage or loss

• Accidents due to negligence (except gross negligence or intentional misconduct)

​

I further agree to hold harmless and indemnify Hooked On Sharks LLC from any claims, lawsuits, or damages arising from my actions or failure to follow instructions.

​

6. Medical & Emergency Treatment Authorization

​

I certify that I am physically fit and capable of participating in this activity. In the event of an emergency, I authorize Hooked On Sharks LLC to seek emergency medical treatment for me if necessary. I understand that I am responsible for any medical costs incurred.

7. Acknowledgment of Refund & Cancellation Policy

​

I understand that:

​

• Hooked On Sharks LLC reserves the right to cancel or reschedule tours due to unsafe weather conditions, equipment issues, or safety concerns.

• If I fail to notify Hooked On Sharks LLC of cancellation within 24 hours of my scheduled tour, I may forfeit any deposit or payment.

• No refunds will be issued for failure to comply with the requirements of this agreement.

8. Photo & Video Release
 

I authorize Hooked On Sharks LLC to take photos or videos during the tour and grant permission for promotional use (social media, website, marketing materials).

9. Severability & Legal Jurisdiction

​

If any part of this agreement is found to be invalid, the remainder shall remain enforceable. This agreement shall be governed by the laws of the State of Florida, and any disputes shall be resolved in the courts of Manatee County, FL.

10. Participant Certification & Signature

​

By signing below, I certify that I:

​

• Have read and understand this waiver

• Understand and accept all risks associated with the activity

• Am voluntarily signing this agreement and waiving legal rights
